Proposed Thai Laws for Vaping in Thailand

    I had asked one of my vendors about this. His reply?
    "Not exactly illegal for use. But its a revenue for police hahahha"

    I had the GF read it and the double speak is there. It's illegal to have an e-cig because taxes haven't been paid. You can be arrested and fined. Then it goes on to say it's OK to smoke your e-cig where regular cigarettes can be smoked.

    No...you cannot vape in public...anywhere. If you do and you're caught by the BiB, then you're guilty of being in possession of an illegally imported item and will be subject to a fine and/or imprisonment.

    Read her follow-on comments...someone specifically asked her about this and she rescinded this part (the bolded part in the quote).

    Bottom line...don't get caught with an ecig by the BiB.

    That reminds me of the times in Bavaria were herb was forbidden to posses but not to smoke. A contradiction in itself.

    If you read through this thread you will see that I made more than one post suggesting it was all about the tax and nothing to do with health issues. Cigarettes are a great source of revenue for the government and they will do whatever is necessary to protect that revenue stream. Anything that threatens the revenue will be attacked. They may yet think of a way to get equal tax from e-cigs and related sales but it is very complicated for them to do. Other countries are dealing with the same issue for the same reasons. Just not placing such harsh penalties. I said before it is all about the money.

    It's always about the money. No matter where you are in the world. I've always said corruption exists everywhere in the world the only difference is the price of admission.

    Thanks for posting this. She makes it very clear how the Bangkok Metropolitan police are interpreting the ban. Possession is illegal.

    Confusing that only 3 months ago the Hat Yai police department had a different interpretation: Songkhla Cops Charged, Suspended for Extorting Malaysian Tourists - Khaosod English
    To summarize:
    Tourist fined for a e-cigarette by the Songkla police.
    Tourist filed a complaint at the Hat Yai police station.
    Hat Yai police charge the Songkla officers with extortion and unlawful detention.

    So the Hat Yai police apparently do not view possession of an e-cigarette illegal.

    As far as how the ban is being enforced nationwide, I think this member had the best answer:

    Still like to hear some further input from these two members:

    Yes, it's very confusing. Since that time, something seems to have changed to make them come up with this latest enforcement ploy. Maybe the cig tax revenues are down...doubt we'll ever find out the catalyst. But it feels like a planned effort...

    Until there's more clarity, I'll vape here like I would in the city-state down south...only in private or at trusted locales.

    Im no lawyer but this reads like it's targeting the clandestine sellers of such equipment….and not the casual tourist or user.

    Maybe the cops did not understand the above wording…or they pretend not to….par for the course in LOS.

    When I bring my laptop into thailand Im also bringing in an item on which thai duty has not been paid. Doesn't a mod purchased outside thailand fall into the same category?

    Perhaps the paraphrase gives that impression, but that is not accurate...according to her original FB post, all sides are covered...buyers, sellers and those simply caught in possession. As @AI-NAAM has noted, as far as the Bangkok BiB are concerned, possession is illegal. There is no 'out' (but I didn't check all the FB comments to see if mods owned prior to the ban may be excluded).

    Whether the BiB throughout the rest of the country will enforce this with the same zeal is yet to be seen. But as noted previously, this is all about the money so the presumption is that there will be some enforcement everywhere.

    At best, if you're caught with a mod in Bangkok, it's going to cost you time & money to extricate yourself from the clutches of the BiB...won't even consider the worst case scenario.

    I think that's it really, another way of gathering 'taxes'. It's very unlikely that anyone will go to prison unless they are caught with a large quantity of vape gear that is obviously for resale - even then a payment could solve the problem

    It's certainly about money, and it's unlikely that casual users will go to prison...but the further you get into any legal system, the more it will cost to get out. Better to not even get started down that money pit. YMMV
